The South Carolina Adoption Act
The South Carolina Adoption Act establishes procedures for the adoption of children and provide for their well-being. It also limits adoption to residents of South Carolina, with the following exceptions; when:
The child has special needs;
The best interests of the child would be served by placement out of state;
The child is to be placed with a biological relative or one related by marriage;
One of the adoptive parents is stationed out of state in the military; or
The child has been in foster care for at least six months and no South Carolina resident has been identified to provide the child’s prospective adoptive home.
