Divorce vs. Separation in South Carolina: What You Need to Know

Below is essential information about divorce and separation in the Palmetto State and the key distinctions between the two.

Divorce in South Carolina requires legal grounds

The state recognizes the following grounds for divorce: 

  • Adultery
  • Physical cruelty
  • Habitual drunkenness or drug use
  • Desertion

Alternatively, if neither party can establish fault-based grounds, a couple may divorce after living separately (without cohabitation) for at least one year.

Separation works differently. South Carolina does not formally recognize legal separation in the same manner that other states do. However, the state does allow a spouse to file for what is called Separate Support and Maintenance, which is available when grounds for divorce do not yet exist or when a couple wishes to live apart and formalize support and custody arrangements without dissolving the marriage. This can be a meaningful option for those who need legal structure during a period of separation.
